Instagram Subscription Creator Terms of Use
These Instagram Subscription Creator Terms of Use (“IG Subscription Creator Terms” or "Terms") govern your (referred to herein as you, your, and/or Creator) participation in an IG Subscription and supplement and amend the Instagram Terms of Use (“Terms of Use”) and all other terms, conditions and policies incorporated therein. These Terms are between you and Meta Platforms, Inc. or Meta Platforms Ireland Limited (as provided under the Terms of Use). Depending on your country of residence, aspects of this service may be owned, operated, or controlled by Meta Platforms, Inc., Meta Platforms Ireland Limited, or its affiliates. References to “us,” “we,” and “our” mean either Meta Platforms, Inc. or Meta Platforms Ireland Limited, as appropriate. Any capitalized terms used but not defined herein have the meaning given in the Terms of Use. IG Subscriptions is accessed through and part of the “Meta Products” provided by Meta Platforms, Inc. (“Meta”), and your use of IG Subscriptions is deemed part of your use of the Instagram Service. In the event of any conflict between these Terms and the Terms of Use, these Terms will govern solely with respect to your use of IG Subscriptions and solely to the extent of the conflict. By joining, using, or otherwise participating in an IG Subscription as a Creator, you agree to these IG Subscription Creator Terms. Please read these Terms carefully.
IG Subscriptions allow Instagram users to support their favorite Instagram Creators through a subscription that provides access to exclusive digital features and digital content that may be made available by Creators. The following definitions apply to these IG Subscription Creator Terms:
Creator means a person or entity that posts IG Subscription Content on Instagram and who creates an IG Subscription.
IG Subscription means a paid monthly subscription made available on Instagram and purchased by Instagram users in exchange for access to certain digital features and/or to a Creator’s IG Subscription Content.
IG Subscription Content means content made available by a Creator to Subscribers who have subscribed to that Creator’s IG Subscription.
Subscriber means any Instagram user who joins an IG Subscription by purchasing a monthly subscription.
Third-Party Platform Provider means a non-Instagram platform, such as the Apple App Store or Google Play, through which a Subscriber purchases an IG Subscription.
  1. Your use of the IG Subscription to offer digital content and/or services to Subscribers is subject to, and you agree to comply with (a) the Community Guidelines; (b) the Instagram Content Monetization Policies, (c) the Instagram Partner Monetization Policies, and the Meta Commercial Terms, as updated from time to time. You agree to follow any additional instructions and/or technical documentation we provide to you for IG Subscription.
  2. When Fans subscribe to your content, you may receive data associated with the Subscriber and their use of their IG Subscription. You agree that you will not use this data for any purpose other than to provide your Subscription and that you will not use data that you receive in connection with the IG Subscription after the IG Subscription has ended, unless you first obtain the Subscriber's permission to do so, consistent with applicable law.
  3. If you provide any information to Subscribers in connection with an IG Subscription, including any digital content or services you choose to offer to them, you must do so truthfully, clearly, and conspicuously. You must disclose all material terms regarding your offer and the nature of content or services you will provide to Subscribers once they choose to subscribe.
  4. You represent and warrant that the content you offer via IG Subscription does not infringe, violate or otherwise misappropriate the intellectual property rights or other proprietary rights (including rights of publicity and rights of privacy) of any third party and that you have secured all rights necessary to distribute, copy, display, publicly perform, or otherwise use the content. You further agree not to use or incorporate any music in connection with your use of IG Subscription unless the music is licensed through Meta’s Sound Collection, you own and/or control all rights in all music included in the content (i.e., you wrote, performed, and recorded all music and lyrics yourself, or you have obtained and paid for licenses from all relevant record companies, music publishers, and other rightsholders to feature the music in your content in all countries where your content is made available including for such music to be performed on the Instagram service), or the music is in the public domain. Any reports of unauthorized use of music or other intellectual property rights may result, among other things, in your content being blocked and/or your use of IG Subscription being terminated.
  5. You may not promote or facilitate any gambling, including, for example, a lottery or a raffle, using IG Subscription. If you communicate or administer a promotion, for example, a contest or sweepstakes, using IG Subscription, you confirm and agree that you are responsible for the lawful operation of that promotion, including with respect to the promotion’s official rules, eligibility restrictions, and compliance with any applicable law or regulation governing the promotion and awarding of prizes (for example, any requirements relating to registration or regulatory approvals). Meta will not assist you in the administration of your promotion, and you confirm and agree that if you use IG Subscription to communicate or administer your promotion, you do so at your own risk. Any such promotion must include a complete release of Meta by each entrant or participant and an acknowledgement that the promotion is in no way sponsored, endorsed, administered by or associated with Meta. For the avoidance of doubt, any such promotion may not award as a prize, or otherwise involve, physical goods.
  6. Meta can terminate or suspend your use of IG Subscription at any time in its sole discretion, and may change or stop offering IG Subscription at any time in its sole discretion. In no event will Meta be liable for terminating or suspending your use of IG Subscription, for the discontinuation of IG Subscription, for the removal of or disabling of access to content, or for the withdrawal of the content from IG Subscription.
  7. If we provide functionality within IG Subscription that allows you to change what’s included in your IG Subscription in a way that could be considered material, you must give Subscribers reasonable prior notice such that they have a reasonable opportunity to cancel their IG Subscription if they so choose, with the change only taking effect after their next IG Subscription fee payment is due. Meta may disable automatic renewals of some or all IG Subscriptions in Meta’s sole discretion.
  8. If a Subscriber is entitled to an IG Subscription refund, or if Meta in its sole and absolute discretion approves an IG Subscription refund, you agree and understand that you will not be entitled to any fees for such IG Subscription during the applicable month.
  9. No Minimum Benefits. Your use of the IG Subscription is entirely voluntary, and does not, in and of itself, guarantee any minimum benefits or amounts payable.
  10. Subscriptions Payment.
      a. Purchases of IG Subscriptions may be processed as payments to Meta via Apple’s In-App Purchase services or Google’s In-App Purchase services, which are subject to Apple’s and Google’s separate payment terms and conditions, or other Third-Party Platform Providers. Apple, Google, and Third-Party Platform providers may charge Meta a revenue share and/or other fees for such payment processing services according to their terms and conditions. Meta will pay you a revenue share calculated as a percentage (“Your Share”) of what’s left of the revenues from purchases of IG Subscriptions after deduction of fees/charges and of any other fees or taxes incurred by Meta (“Net Revenue”). At the end of the Term, Meta may deduct for itself a revenue share of Net Revenue. Meta may disable some or all IG Subscriptions in Meta’s sole discretion. Meta may in the future change the revenue share provisions contained in these IG Subscription Creator Terms.
      b. Meta reserves the right to offer discounted IG Subscriptions in its discretion from time to time. In such instances, Your Share will be reduced accordingly, and you will only receive a revenue share based on the amounts Subscribers actually pay (less fees and taxes incurred by Meta).
      c. Subject to this letter, and provided that you have accurately completed and timely provided to us any forms or documentation that we request to set up payment to you (which payment information you must keep accurate and up-to-date), and provided that you have the requisite authority to provide such information, payments will be made within approximately 30 days after the end of the calendar month in which such Net Revenue is generated. We will not be responsible for any subsequent fees applied by your financial institution to complete payment to you. Furthermore, in the event the payment due to you would be less than twenty-five United States Dollars ($25.00), we reserve the right to roll such payment over month to month until the payment threshold of twenty-five United States Dollars ($25.00) is met (unless your account is deactivated or terminated, in which case you forfeit any accrued amounts), at which time we will make the applicable payment to you. We reserve the right to deduct from any payments due or payable to you any amounts that are past due and remain uncollected by us from you in connection with any other Meta product or service. If you are acting as an agent (including, but not limited to, an agent or representative of Creator), you represent and warrant that you are authorized to provide the specific payment information which you give to us and, where applicable, to receive payment from us. We are not responsible for, and will not adjudicate, any disputes between you and any other agent or entity relating to (a) the payment information that you provide to us or (b) the payment or any apportionment of the payment between you and any third party.
      d. In the event that any remittance made by us to you is subject to any Withholding Taxes (defined below), the full amount of any such Withholding Taxes shall be solely for your account. We may deduct the full amount of such withholding tax from the gross amount owed to you, and will pay the full amount withheld over to the competent tax authorities.
      e. Where applicable, you accept that completion of the payment enrollment process within six months after you accept these Terms is a condition of payment. If you do not complete the payment enrollment process within six months after accepting these Terms, you forfeit and waive all rights to receive payment of any funds.
  11. Taxes. You shall be responsible for compliance with all local tax regulations including but not limited to reporting, deposit and payment of any and all federal, state, and local taxes related to the performance of, or payment, or benefit received through your use of IG Subscriptions. You agree to accurately complete and timely provide to Meta any forms or documentation that Meta reasonably determines are required to set up payment to you. In addition, you will provide Meta with applicable tax ID, tax forms, documents, or certifications as may be required by applicable law for Meta to satisfy any tax information reporting and/or withholding tax obligations with respect to any payments hereunder (collectively “Withholding Taxes”). Where applicable, Meta shall be entitled to deduct and withhold from any consideration payable such amounts as are required to be deducted or withheld therefrom under any provision of US Federal, state, local or foreign tax law, or under any other applicable law. Where applicable, you (a) agree that Meta will prepare and issue VAT invoices under a self-billing arrangement, (b) acknowledge and accept the validity of such self-billed invoices, and (c) agree that you will be responsible for timely remittance to applicable tax authorities of any tax amounts on such self-billed invoices that were paid to you by Meta. You shall use best efforts to assist Meta in all legal efforts to minimize the taxes resulting from your use of IG Subscription.
  12. Notice. You agree to receive electronic communications regarding your use of IG Subscription, payments, and other related topics. You also agree to receipt of such communications through the Meta Products, via the e-mail address provided to us, or by mail at the street address that you provided to us. Notices via Meta Products and e-mail shall be deemed received by you within twenty four (24) hours of the time posted or sent; notices by mail shall be considered received within three (3) business days of the date sent.
  13. If you provide (or allow Meta to access) any data, content, or other information in connection with your use of IG Subscriptions (collectively, “Supplemental Data”), then you grant Meta (and its affiliates) a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use such Supplemental Data. This license survives even if you stop using IG Subscriptions. You are responsible for obtaining the necessary rights from all applicable rights holders to grant this license.
  14. If you are using IG Subscriptions on behalf of a third party (including, but not limited to, as an agent or representative of a Creator), you represent and warrant that you have the authority as agent of such party to use such features on their behalf, agree to these Terms, and hereby bind such party to these Terms. You agree to indemnify and hold Meta harmless from any claims, suits, losses, liabilities, damages, costs, and expenses resulting from your breach of the Terms.
  15. Meta reserves the right to update these Terms from time to time. If any change to these Terms is material, we will provide you with notice before the change becomes effective, so that you can choose to terminate or discontinue your use of IG Subscriptions. Your continued use of IG Subscriptions despite material changes to the Terms constitutes acceptance of such changes.
