Amended Terms for Federal, State, and Local Governments in the United States

If you are a federal, state, or local government entity or government official in the United States ("You"), and You are using the Instagram Service in your official capacity for official government purposes ("Official Use"), the following terms ("Amended Terms") apply solely to such use and all other terms and conditions ("Terms of Use") shall remain in effect. With respect to your Official Use of the Service, in the event of any conflict between these Amended Terms and the Terms of Use, these Amended Terms shall control.
  1. Disputes
    2. You and Meta will in good faith try to resolve disputes in an amicable fashion. To the extent arbitration is prohibited by applicable law, provisions in the Terms of Use relating to Arbitration shall not apply to your Official Use of the Service.
  2. Governing Law & Venue
    3. Terms relating to venue and governing law do not apply to your Official Use to the extent that applicable law prohibits their application. For federal government entities, the Terms of Use and any action related thereto will be governed by the laws of the United States of America (without reference to conflict of laws) and, to the extent permitted under federal law, the laws of the State of California will apply.
  3. Indemnification
    4. For federal government entities and officials in the United States, provisions in the Terms of Use relating to Indemnification shall not apply to your Official Use, except to the extent expressly authorized by federal law. For state and local government entities and officials in the United States, Terms of Use relating to Indemnification shall apply to your Official Use only to the extent not prohibited by the laws of your jurisdiction.
  4. Time Limitation on Claims
    5. The section on Time Limitation on Claims in the Terms of Use shall not apply to claims related to your Official Use.
  5. Endorsement
    6. For federal, state, and local government entities and officials in the United States, we agree that we will not use your entity's seals, trademarks, service marks, trade names, and the fact that you have a presence on the Instagram Service, to state or imply an endorsement of the Service. However, the foregoing shall not prohibit us from using your seals, trademarks, service marks, trade names, and the fact that you have a presence on the Instagram Service, as necessary for our regular operation of the Service.
